The main function of the policy and cases committee is to provide the Accountant in Bankruptcy with advice on challenging cases and policy issues which may:

Be complex

Be potentially high profile
-
Have a reputational risk
-
Require consideration for a change to legislation

Have a public interest where pursuit would be at public expense not recoverable from anticipated case income

Set a case precedent
The committee is a sub-committee of the advisory board and has no authority in its own right over any policy or cases issues.
It will provide advice to the Accountant in Bankruptcy and it is for the Agency to decide if it accepts this advice.
Advice given by the committee will not constitute legal advice. If legal advice is required, it will be provided through the Scottish Government's legal department or one of AiB's legal agents.
