Scenario

The debtor asked for a review of the decision to allow the trustee to be replaced and for a new trustee to be put in place. The trustee submitted an application to be replaced as trustee in multiple sequestrations because he planned to retire and would be giving up his Insolvency Practitioners licence. The debtor objected on the grounds that she had not received a copy of the application from the trustee. The trustee’s office provided a certificate of posting which showed that the debtor had been included in the mailing circular.

Decision

The reviewing officer confirmed the trustee’s original decision, and the trustee was replaced.
