Regulations to widen access to MAP laid
Draft regulations aimed at improving access to debt relief and increasing protection for specified assets have been laid before the Scottish Parliament.
The Bankruptcy and Attachment (Miscellaneous Amendment) (Scotland) Regulations 2026 were laid in draft before the Scottish Parliament on 7 October 2026.
Key proposed changes
If approved, the regulations will:
- Broaden the entry criteria for Minimal Asset Process (MAP) bankruptcy, allowing more people to access MAP where it is the most suitable statutory debt solution, rather than entering full administration bankruptcy
- Increase the value of certain items protected in bankruptcy and diligence, including:
- vehicles
- tools of the trade
- sentimental items
Next steps
The regulations are now subject to parliamentary scrutiny.
Subject to approval by the Scottish Parliament, the majority of the provisions are expected to come into force on 1 April 2027.
