Appointment of commissioner at statutory meeting or a meeting of creditors

If a commissioner is appointed at a statutory meeting, a copy of the minutes and a list of the attendees should be uploaded to the documents section on BASYS. The minutes should include the name and correspondence address of the commissioner. 

It would be helpful if the appointment of the commissioner is brought to the AiB’s attention by email or BASYS notification to allow us to update the case.

Commissioner account documentation

Copies of any documentation submitted to the commissioner for audit and determination, and copies of the commissioner’s determination should be uploaded to the relevant account on BASYS as per Section 132(2) of the Bankruptcy (Scotland) Act 2016.

If a commissioner has been appointed, any requests to extend the accounting period should be made to the commissioner as per Section 130(3)(b)(i) of the Act and a copy of the agreement uploaded to the relevant account on BASYS.

Trustee’s proposals for action on heritage

Trustees must continue to submit their proposals for action on heritage to AiB for agreement prior to proceeding with any action.

This is not a function of the commissioner.
