Trustee formal adjudication

Adjudication circular

In accordance with Section 126(7) of the Act, where the trustee accepts or rejects a claim, the trustee must record the trustee’s decision on the claim, specifying the amount of the claim accepted, the category of the debt and the trustee’s reasons for rejecting the claim.

Section 127(1) allows the debtor or any creditor the right of review of the acceptance or rejection of any claim, or of the amount or category of the claim. 

Please therefore ensure that adjudication circulars clearly state the classification of adjudicated claims.

Please note that petitioning costs should not be included within the adjudicated ordinary claim and that the debtor and creditors do not have the right of review in respect of this.
