6. Mental Health Moratorium
The introduction of a Mental Health Moratorium in Scotland, which will provide special protections from debt enforcement for those individuals with serious mental health conditions, has received broad support from stakeholders.
The Bankruptcy and Diligence (Scotland) Bill, which includes the Mental Health Moratorium provisions, was approved by Scottish Parliament on 6 June 2024.
How will we know we’ve been successful?
AiB will have completed the following:
develop regulations for the moratorium
develop guidance for applying the regulations
engage with stakeholder groups and relevant sector experts, building awareness and defining the detail of putting the moratorium into practice
develop a standalone moratorium case management system incorporating the existing service and the new mental health moratorium
